แถลงการณ์ร่วม 4 องค์กรวิชาชีพสื่อมวลชนต่อคำสั่งที่ 3/2558 ของหัวหน้ารักษาความสงบแห่งชาติ

 

ตามที่หัวหน้าคณะรักษาความสงบเรียบร้อยแห่งชาติ อาศัยอำนาจตามความในมาตรา 44 ของรัฐธรรมนูญแห่งราชอาณาจักรไทย (ฉบับชั่วคราว) พุทธศักราช 2557 ออกคำสั่งที่ 3/2558 โดยในข้อ 5 ของคำสั่งดังกล่าว ระบุว่า ให้อำนาจเจ้าพนักงานรักษาความสงบเรียบร้อยมีอำนาจออกคำสั่งห้ามการเสนอข่าว การจำหน่าย หรือทำให้แพร่หลายซึ่งหนังสือ สิ่งพิมพ์ หรือสื่ออื่นใด และได้กำหนดโทษสำหรับผู้ฝ่าฝืนหรือไม่ปฏิบัติตามคำสั่งต้องระวางโทษจำคุกไม่เกินหนึ่งปี หรือปรับไม่เกินสองหมื่นบาท หรือทั้งจำทั้งปรับนั้น คำสั่งนี้มีเนื้อหาที่กระทบต่อสิทธิเสรีภาพของประชาชนและสื่อมวลชนมากยิ่งขึ้นกว่ากฎอัยการศึก

 

ในส่วนของประชาชนทั่วไปนั้นถ้าการสื่อสารผ่านโซเชียลมีเดียใดถูกตีความว่า เป็นการกระทำตามข้อ 5 เป็นข้อความอันอาจทำให้ประชาชนเกิดความหวาดกลัว หรือเจตนาบิดเบือนข้อมูลข่าวสารฯลฯ ต้องได้รับโทษดังกล่าว ส่วนสื่อมวลชนก็เป็นไปในลักษณะเดียวกัน

 

4 องค์กรวิชาชีพสื่อสารมวลชน ประกอบด้วย สมาคมนักข่าวนักหนังสือพิมพ์แห่งประเทศไทย สภาการหนังสือพิมพ์แห่งชาติ สมาคมนักข่าววิทยุและโทรทัศน์ไทย และสภาวิชาชีพข่าววิทยุและโทรทัศน์ไทย มีความเห็นร่วมกันว่าการออกคำสั่งในข้อดังกล่าว เป็นการให้ดุลพินิจกับเจ้าพนักงานรักษาความสงบเรียบร้อยอย่างกว้างขวาง หากไม่มีหลักเกณฑ์หรือเงื่อนไขในการปฏิบัติที่ชัดเจน เพื่อให้เจ้าพนักงานใช้ดุลพินิจว่าข้อความใดทำให้ประชาชนเกิดความหวาดกลัว หรือเจตนาบิดเบือนข้อมูลข่าวสาร ทำให้เกิดความเข้าใจผิด จนกระทบต่อความมั่นคงของชาติ หรือความสงบเรียบร้อยของประชาชนนั้น อาจนำไปสู่การปฏิบัติ ที่ไม่ได้เป็นไปตามเจตนารมณ์ของคำสั่ง

 

4 องค์กรวิชาชีพสื่อสารมวลชน มีความเห็นร่วมกันว่า หัวหน้าคณะรักษาความสงบเรียบร้อยแห่งชาติ ควรให้นโยบายที่ชัดเจนต่อเจ้าหน้าพนักงานรักษาความสงบเรียบร้อย หรือกำหนดมาตรการหรือเงื่อนไขในการปฏิบัติงานของเจ้าพนักงานรักษาความสงบเรียบร้อยตามอำนาจในวรรคสองของข้อ 5 ที่ชัดเจน เพื่อประชาชนทั่วไปและสื่อมวลชนทุกแขนงซึ่งได้รับผลกระทบโดยตรงจากคำสั่งดังกล่าว จะได้มีความสบายใจขึ้นว่าการใช้อำนาจตามบทบัญญัติ มาตรา44 แห่งรัฐธรรมนูญชั่วคราวจะเป็นไปอย่างสร้างสรรค์ดังที่หัวหน้าคณะรักษาความสงบแห่งชาติให้สัญญาประชาคมไว้ เพราะคำสั่งดังกล่าวกระทบสิทธิขั้นพื้นฐานอย่างยิ่ง

 

ทั้งนี้ 4 องค์กรวิชาชีพสื่อสารมวลชน ขอแสดงความห่วงใยต่อการใช้อำนาจดังกล่าวว่าควรเป็นไปอย่างรอบคอบและระมัดระวังอย่างถึงที่สุด เพราะกรณีนี้น่าจะกระทบต่อการประเมินสถานะของประเทศในด้านสิทธิเสรีภาพของสื่อมวลชนและประชาชนของประชาคมโลก และจะเป็นปัญหาที่ถูกหยิบยกมากล่าวถึงในวันสิทธิเสรีภาพสื่อมวลชนโลกวันที่ 3 พฤษภาคมนี้

Joint Statement of 4 Thai Professional Press Organizations

On the NCPO Order Number 3/2558

 

The National Council for Peace and Order (NCPO) issued order no.3/2558, in order to invoke section 44 of the Interim Constitution of the Kingdom of Thailand (2014) to replace the Martial Law on April 2, 2015. According to article number 5 of the section 44, it gives the security authorities power to ban any news report, sale and distribution of book, publications and other medium that the NCPO deemed as security threat. Any person who does not comply with the article will be punished with maximum of one year jail term, or a fine not exceeding to 20,000 baht, or both. Thus, this article is the greater threat to press freedom and freedom of expression than the lifted Martial Law.

 

Civilian is also at risk, as people who communicates and discusses topics through online social media that contain information viewed by the authorities as threat to national security, cause of public alarm, spreading of false information or public misunderstanding will be punished on the same condition.

 

The Thai Journalists Association, the National Press Council of Thailand, the Thai Broadcasting Journalists Association and the News Broadcasting Council of Thailand are very concerned about the broad context of the articles under section 44 that empower the authorities to conduct any actions on their discretions. Without any clear definition of national security threat, cause of public alarm and dissemination of false information, the authorities might over-exercise or abuse their power, which is very contradicting to the NCPO order.

 

The four professional press organizations jointly urge the NCPO to set the clear rules, guidelines and procedures for the security authorities in conducting their duties under article no.5 of the section 44, as it can severely affect the fundamental human rights. People and press must be ensured that the authorities will exercise their power in prudent and positive manners as pledged before by the NCPO.

 

Furthermore, the four professional press organizations request the NCPO to carefully consider about the consequence from the use of section 44 that has already affected press freedom and basic rights of the citizen of Thailand. The situation in Thailand will also be widely reported and discussed at the incoming event of Press Freedom Day on May 3, 2015.
